1.1 This statement concerning the process of personal data ("Data Protection Policy") describes how Pronghorn Racing ApS collects and processes information about you as our customer.
1.2 The Data Protection Policy covers all personal data that you submit to us, or we collect via Pronghorn Racing ApS´ website www.pronghornracing.dk.
1.3 Pronghorn Racing ApS is data controller of your personal data. Enquiries to Pronghorn Racing ApS should be made via the contact information listed under item 7.
2. WHAT DATA DO WE COLLECT, FOR WHAT PURPOSE, AND LEGAL BASIS FOR THE PROCESS
2.1 When you visit our website, we automatically collect information about you and your use of the website, including the type of browser you use, your search terms on the website, your IP address including network location and information about your computer.
2.1.1 The purpose is to optimise user experience and function of the website in addition to targeted marketing, including retargeting via Facebook and Google. This data process is necessary in order for us to make improvements to the website and present you with relevant offers.
2.1.2 The legal basis for the processing is the EU General Data Protection Regulation (GDPR) article 6, item 1, (f).
2.2 When you purchase a product or communicate with us on the website, we collect the information you give us, e.g. name, address, email address, telephone number, payment method, information on purchased product(s) and any returned product(s), delivery request in addition to information about the IP address that placed the order.
2.2.1 The purpose is to deliver the ordered products and in all other respects fulfil our agreement with you, including administration of your right to return and complain. Information about your purchases may also be processed in order to comply with legislation, including accounting and accounts. When a purchase is made the IP address is collected for the above purpose and in order for us to prevent fraud.
2.2.2 The legal basis for the processing is the EU General Data Protection Regulation (GDPR) article 6, item 1, (b), (c) and (f).
2.3 When you subscribe to our newsletter, we collect information about your name and your email address.
2.3.1 The purpose is for us to be able to send you newsletters.

3. RECIPIENTS OF PERSONAL DATA
3.1 Information about your name, address, email, phone number and specific delivery requests are forwarded to GLS, Danske Fragtmænd or another carrier in charge of delivering the purchased items to you
3.2 Information can also be forwarded to external partners that process the information on behalf of us. We make use of external partners in connection with e.g. technical operations and website improvements. These companies are data processors and are instructed by us, and process data for us in our capacity as data controllers. Data processors are not allowed to use information for any other purpose than to fulfil the agreement with us and are under an obligation to keep this information confidential. We have entered into written data processor agreements with all data processors that process personal data on our behalf.
3.3 The below data processors have been established in the USA. The necessary guarantees for transfer of information to the USA have been secured through the data processors certification under EU-U.S. Privacy Shield, cf. EU's General Data Protection Regulation (GDPR) art. 45.

4. YOUR RIGHTS
4.1 With a view to creating openness in connection with our processing of your data we are under an obligation to inform you of your rights.
4.2 Right of access
4.2.1 You are at any time entitled to request information on, among others, the information we register about you, purpose of the registration, categories of personal data and recipients and any information in addition to information on where the data originates.
4.2.2 You have the right to request a copy of any personal data that are being processed. Should you request a copy of your personal data, please send a written enquiry to email@example.com. You may be asked to document that you are the person you say you are.
4.3 The right to rectification
4.3.1 If your personal data is inaccurate, you have the right to have the data rectified. If you become aware of incorrect data in the information we have on you, please contact us in writing in order for us to rectify the matter.
4.4 The right to erasure
4.4.1 In certain cases you have the right to have all or some of your personal data erased, e.g. if you revoke you accept and there is no legal basis for us to continue the processing. To the extent a continuous processing of your data is necessary, e.g. in order for us to fulfil our legal obligations, or to determine, enforce or defend a legal claim, we are not obliged to erase your personal data.
4.5 Right to restriction of processing
4.5.1 Under certain circumstances you have a right to obtain restriction of processing of your personal data to include solely storage, e.g. if you believe that information we process about you is not correct.
4.6 THE RIGHT TO DATA PORTABILITY
4.6.1 In certain cases you have the right to receive the personal data concerning you have provided us in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller.
4.7 THE RIGHT TO OBJECT
4.7.1 At any time, you have the right to object to our processing of your personal data with a view to direct marketing including profiling with a view to target our direct marketing.
4.7.2 Furthermore, at any time, you have the right to, for reasons concerning your personal situation, to object to the processing of your personal data that we carry out on the basis of our legitimate interest, cf. item 2.1 and 2.3.
4.8 THE RIGHT TO WITHDRAW CONSENT
4.8.1 You have the right to withdraw your consent at any time to the processing of personal data. Should you wish to withdraw your consent, please contact us at firstname.lastname@example.org.
4.9 THE RIGHT TO LODGE A COMPLAINT
4.9.1 You have the right at any time to lodge a complaint to Datatilsynet, Borgergade 28, 5, 1300 København K about our processing of your personal data. Complaints can among others be lodged by email to email@example.com or telephone +45 33 19 32 00.
5. DELETION OF PERSONAL DATA
5.1 Information collected in connection with your use of the website, cf. item 2.1., will at the latest be deleted when you have not visited our website for three (3) years.
5.2 Information collected in connection with your subscription to our newsletter will be deleted once your accept of receiving newsletters is revoked, unless we have others grounds for further processing of the information.
5.3 Information collected in connection with a purchase on our website, cf. item 2.2, will as a basis be deleted three (3) years after the end of the calendar year where you made the purchase. Information can, however, be kept for a longer period of time, if we have a legitimate need for this, e.g. where this is necessary to determine, enforce or defend legal claims or if storage is necessary for us to fulfil legal claims. Accounting records are kept for five (5) years until the end of an accounting year in order to comply with the Danish Bookkeeping Act.
6.1 We have implemented adequate technical and organisational safety precautions to prevent personal data accidentally or unlawfully being destroyed, lost, altered or impaired in addition to preventing disclosure to or misuse by unauthorized persons.
6.2 Only employees with an actual need to access your personal data to perform their work have access to this.
